The Road Traffic Accidents: The Tips On Legal Proceedings





The traffic on our roads is always ever increasing on daily basis and the reckless driving of some of our drivers has resulted in various road accidents; and accident victims have in so many cases establish lawsuits to claim for compensation especially when personal injury takes place and death may even results in most cases. However, if you really want to embark on any legal proceedings to claim for compensation, then it is your duty to learn the right ways to it without being subjected to horrendous situation that will backfire on you.

Non-Certification Of The Driver: Some of our drivers nowadays don’t even have the right to be on the wheel because they have not being certified to be capable of driving at all. Some may not have driving licence and once your are not certified to drive a particular vehicle you may not be able to drive such vehicle to ensure the safety of other road users.

Bad Driving Habits- This is known to be the major reason for most of our road traffic accidents among us. Simple errors in most cases can lead to bad judgment in driving. Road mishaps most often than not all add up to poor or driving habits among our drivers. Such bad habits include lack of knowledge about road traffic signs and symbols that can guide against road accidents, some drivers at times do ignore traffic signals, over-speeding, poor negotiation of bends, not giving way to other road users as when necessary, tailgating and mobile phone usage while driving.

Loss Of Concentration While Driving- Some of our drivers are oftentimes takes things for granted and through this lose concentration when they are supposed to have full concentration of what is ahead of them. Distraction has been named among the major reasons why accidents are on the increase nowadays. A lot of things can be attributed be responsible for this such as tuning of car stereo when you are on top speed, distraction either from outside or inside of the car, reading of maps or newspapers, fixing of mirror when your attention is supposed to be on the road, too much talking that ay lead to argument or while trying to comfort an upset child all contribute in no small ways to cause road traffic accidents.

Driving Under The Influence Of Drugs Or Alcohol – A lot of awareness to adequately sensitize our drivers for the dangers inherent in driving while under the influence of drugs and alcohol have always being made available but yet some of our drivers have always neglected the advise to the detriment of other road users. While under the influence of drugs or alcohol the driver will be subjected to the impaired ability to concentrate fully about the road condition as well as other road users. This will no doubt put the life of other road users at risk.

Bad Weather Conditions – Unfavourable weather is another major reason for most of our road traffic accidents. This is particularly common during heavy rain period or dry season when fog, mist or clouds will take over the atmosphere. This normally reduces visibility to a very short distance that will prevent drivers to see far ahead for good motoring.  During the raining period the road may also be slippery. Slippery road surfaces require the driver to take extra care while behind the wheel. Our motorists should endeavour to take note of these weather conditions to plan ahead of how their journey will look like. This is highly important especially if you want to go on a long journey. You’ll have to know that once the weather is not favourable to go on high speed, then you should try as much as possible to leave home very soon enough to get to your destination on time. 
Other weather conditions such as black ice and flash flooding also do create unexpected obstacles a driver will have to take special considerations of while driving. You’ll also have to know that it’s highly important for you to have a better understanding of how to get weather report and do check to know if there is any special consideration to look out for harsh road conditions as a result of bad weather.

Poor Or Inadequate Road Design – It is the responsibility of the government to make available a clear, appropriate and adequate road signs and symbols to ensure that accurate information are provided as at when due to all road users. A hilly or sloppy area, sharp bend, narrow bridge and other symbols should be provided to ensure that life and properties of all road users are secured and protected. You should know that as a road user you have responsibility to other road users as well, to prevent the occurrence of road accidents. However, liability can be called upon when confusing, poorly placed signs, barriers, road works or traffic signals are a contributing factor to road traffic accidents.

Roadworthy Vehicles- On traffic record quite a large number of road accidents are confirmed to be caused by vehicles that are not being road worthy. Several factors can be attributed to this such as poor tyres, brakes failing, technical or electrical failure and other similar defects can all cause road accidents.
